1. About these terms

These terms govern your use of the Expert Evidentia website and application (the Service), operated by [Legal entity name and registered address] (we, us). By creating an account or using the Service you agree to them. If you use the Service for a firm or organisation, you confirm that you may bind it.

2. What Expert Evidentia is

Expert Evidentia is a platform that connects law firms with expert witnesses and gives experts tools to research, draft, verify and sign their reports.

We are not a law firm. We do not give legal advice, and nothing on the Service creates an attorney-client relationship. Firms are responsible for their own legal strategy and for the procedural and evidentiary requirements that apply to their matter.

We are not a party to the engagement between a firm and an expert unless a separate written agreement says so.

3. Accounts and roles

The Service has three kinds of account: firm users, expert users and administrators. During early access we may set up firm accounts by invitation, and experts may apply to join.

  • Give accurate, current information and keep it up to date.
  • Keep your sign-in details secret. You are responsible for activity under your account.
  • One account per person. Do not share accounts.
  • Tell us promptly at the contact address below if you suspect unauthorised access.

4. Expert vetting and approval

Every expert application is reviewed by a person on our team. We may ask for more information, and we may approve, decline or suspend an expert at our discretion. We are not required to give reasons.

Approval means an expert has passed our review for access to the Service. It is not an endorsement, a certification, or a statement that a court or tribunal will accept the expert or their opinion.

Experts must disclose anything a court or opposing counsel could reasonably raise about their qualifications, conflicts or prior testimony. An undisclosed issue may lead to removal.

5. Offers and engagements

Firms may send offers to approved experts. An expert may accept or decline any offer. Before an expert accepts, a firm sees only an anonymous profile. After acceptance, the expert's name, employer and CV are shared with that firm.

Scope, fees, deadlines and deliverables are agreed between the firm and the expert. The Service does not currently process payments or invoices. [Fee, payment and billing terms to be added if the platform handles payments.]

6. Expert independence and responsibility

Experts are independent professionals, not our employees or agents. Each expert alone is responsible for their methodology, analysis, conclusions and signed report, and for staying within their area of expertise.

A firm may not direct an expert to adopt a particular conclusion. Experts must review every statement and source in a report before signing it, and sign only what they believe to be true.

7. AI-assisted drafting

The Service uses artificial intelligence to help experts outline, draft, find sources and check facts. AI output can be wrong, incomplete or out of date, and a located source is not proof that it supports a statement.

The expert reviews, edits, rejects or replaces anything the tools suggest, and signs the final report. We do not warrant that AI-assisted output is accurate, complete or fit for any purpose.

Text you enter into drafting and fact-checking tools may be processed by third-party AI providers on our behalf. See the Privacy Notice. [AI provider terms, including any restriction on training use, to be confirmed.]

8. Confidentiality

Case materials in the Service are visible to the firm that owns the case and to the expert engaged on it. Other firms and experts do not see them. A limited number of our staff may access case data to operate, secure and support the Service. [Staff access rules to be confirmed.]

Do not send confidential case material through the public website forms. Use the application, after an account and case exist.

Firms and experts must keep the other party's confidential information confidential and use it only for the engagement. [Confidentiality terms between firm and expert to be confirmed.]

9. Acceptable use

You agree not to:

  • Provide false or misleading information, including false credentials or disclosures.
  • Upload unlawful content, malware or material you have no right to share.
  • Attempt to access another user's data, or to probe, disrupt or reverse engineer the Service.
  • Use the Service to deceive a court, tribunal or other party.
  • Scrape the Service, or use it to build a competing database of experts.

10. Content and ownership

You keep your rights in the content you submit. You give us a limited licence to host, process and display it as needed to run the Service for you and the other party to your engagement.

We and our licensors own the Service and its software and branding. Ownership of a signed report as between a firm and an expert is set by their engagement. [Report ownership default to be confirmed.]

11. Suspension and termination

We may suspend or close an account, remove content, or limit access if we reasonably believe these terms have been broken, an expert's disclosures were inaccurate, or the Service or other users are at risk. You may close your account at any time by contacting us. Provisions that by their nature should survive closure will survive.

[Treatment of active engagements, exports and data on closure to be confirmed.]

12. Disclaimers

The Service is provided as is and as available. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose. We do not guarantee that any expert will be available, that any report will be admissible or persuasive, or that any case will have a particular outcome.

13. Limits of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, and our total liability for any claim relating to the Service is limited to [liability cap].

Nothing in these terms limits liability that cannot be limited by law. [Carve-outs to be confirmed by counsel.]

14. Changes to these terms

We may update these terms. We will post the new version with its effective date and, for material changes, tell account holders. Continued use after the effective date means you accept the update.

15. Governing law

These terms are governed by the laws of [Governing law and venue]. Disputes will be heard in the courts of that place unless a separate agreement says otherwise.

16. Contact

Questions about these terms: [Contact email for legal and privacy requests]. Effective date: [Date].
